Ainda em Busca da Constituição Monetária: uma análise jurídico-institucional do regime de metas de inflação

O artigo analisa o regime brasileiro de metas de inflação à luz do direito constitucional e monetário. Demonstra-se que, embora eficaz na promoção da estabilidade de preços, o atual arcabouço ainda carrega o legado de um passado de hipertrofia e excessiva concentração de poderes no Poder Executivo, no que se refere às decisões sobre metas de inflação, em detrimento da participação e da responsabilidade do Poder Legislativo, resultando em um arranjo com baixa legitimidade e pouco pluralismo político. A fim de endereçar esse déficit democrático, o artigo propõe que a meta de inflação passe a ser aprovada pelo Poder Legislativo, com base em proposta técnica elaborada e discutida no âmbito do Conselho Monetário Nacional (CMN), com ampla participação de especialistas, representantes da sociedade civil organizada. Sustenta-se que tais medidas ampliam a legitimidade, o pluralismo político e a responsividade da política monetária, ao mesmo tempo que protegem e preservam a reputação institucional do Banco Central
