Consumer Protection in the Cryptocurrency Market

ABSTRACT: With the advent of blockchain technology, the commercialization of digital assets such as cryptocurrencies became possible, forming a rapidly expanding market, involving thousands of users and large amounts of money around the world. In this context, new legal issues arise to be faced by national governments, such as consumer protection in the cryptocurrency market. Although some countries have simply banned cryptocurrencies, given the difficulty of regulating them, the majority have moved from a more passive, observational stance to one more focused on protecting investors, imposing a series of conditions on the activity of cryptocurrency exchanges that operate in this market. The present study seeks to analyze some of these regulatory frameworks, including in Brazil, in order to extract brief findings about the current state of consumer protection in this increasingly dynamic and challenging cryptographic environment.
