Direito dos Planos Econômicos: investigação de legitimidade das políticas públicas monetárias

The purpose of this study is to analyze models of legitimacy of public monetary policies adopted during Brazilian economic plans in the 1980s and 1990s. To explore the public decision-making model, the research identified and collected opinions issued by consultancies of the Federal Government’s legal bodies and that had been issued between 1985 and 1996, inclusive. The work took advantage of the categories set out by José Eduardo Faria and classified the opinions within the models of formal rationality and material rationality. The result indicates that half of the acts analyzed fit the model of material rationality. The research demonstrated that the Brazilian monetary experience of this historical period cannot be examined from a solely legal or economic perspective and that legal sociology concepts are relevant to understanding the monetary law of economic plans.
